A letter seeking permission to initiate criminal contempt proceedings against BJP MP Nishikant Dubey over his remarks against the Supreme Court and the Chief Justice of India (CJI) has been sent to the Attorney General of India.
According to a LiveLaw report, published on Sunday, the letter mentioned Dubey's criticism of the Supreme Court and the swipe he took at CJI Sanjiv Khanna.
Dubey had launched a broadside against the SC, saying Parliament and state assemblies should be shut if the apex court had to make the laws. He alleged that CJI Sanjiv Khanna was responsible for "civil wars" in the country.
"Kanoon yadi Supreme Court hi banayega to Sansad Bhavan bund kar dena chahiye," the BJP MP said in post in Hindi on X without elaborating.
Later, in remarks to PTI, Dubey accused the court of arrogating to itself Parliament's legislative powers by striking down laws passed by the legislature and even giving directions to the President who, Dubey noted, is the appointing authority of Supreme Court judges.
“Supreme Court is responsible for inciting religious wars in the country. The Supreme Court is going beyond its limits. If one has to go to the Supreme Court for everything, then Parliament and State Assembly should be shut,” Dubey had told ANI.
At another instance, while speaking to ANI, Dubey said, “Chief Justice of India, Sanjiv Khanna, is responsible for all the civil wars happening in this country.”
Former Bihar deputy chief minister and RJD leader Tejashwi Yadav, while agreeing to a contempt action againt Dubey, said on Sunday that such remarks statements undermine the dignity of the judiciary and warrant contempt proceedings.
“Such comments should not be made on the Court, and if someone makes such comments, contempt proceedings should be initiated, ” told ANI.
Mere hours after Dubey's remarks stirred a controversy, the BJP was quick to distance itself from his statements, calling them “personal comments”.
BJP chief JP Nadda said that the BJP neither agrees with such statements nor does it support such remarks. "The BJP completely rejects these statements," said Nadda in a post on X.
"These are their personal statements, but the BJP neither agrees with such statements nor does it ever support such statements. The BJP completely rejects these statements,” Nadda said.
Samajwadi Party chief and MP Akhilesh Yadav on Sunday slammed the Bharatiya Janata Party over party MP Nishikant Dubey's recent remarks, noting that whatever Godda Lok Sabha MP said reflects the thinking of the BJP.
While addressing the media in Prayagraj, the Samajwadi party chief alleged that the BJP is responsible for creating divisions in society, be it in the name of religion or caste.
"The truth is that if anyone is creating rifts between religions, then it is the BJP. Creating a divide in society in the name of religion, caste is a very well-planned programme of the BJP, and they spend funds on it. Whatever was said is the thinking of the BJP," Yadav said.
